1. About these terms

These Terms and Conditions govern your use of Artistivo (“the platform”). By accessing or using Artistivo, you agree to be bound by these terms. If you do not agree, please do not use the platform.

Artistivo is operated from the United Kingdom. These terms are governed by the laws of England and Wales, without prejudice to any mandatory consumer protection laws applicable in your country of residence, including those of the European Union.

2. Eligibility

You must be at least 18 years of age to create an account on Artistivo. By registering, you confirm that the information you provide is accurate, complete, and up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. Your content

1. 3.1 Ownership

   You retain full ownership of all content you upload to Artistivo, including but not limited to images, videos, written work, and any other creative material (“your content”). Nothing in these terms transfers ownership of your work to Artistivo.

2. 3.2 Licence you grant us

   By uploading content to Artistivo, you grant us a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute your content solely for the purpose of operating and promoting the platform. This includes showing your work on your profile, in search results, in featured sections, and in Artistivo’s own promotional materials such as social media, press, and marketing.

   This licence does not allow us to sell your work, license it to third parties for commercial gain, or use it in any way that suggests endorsement of a third-party product or service without your explicit written consent.

3. 3.3 What we will never do

   We will never:

   • Sell your work or grant commercial rights over it to any third party
   • Use your work in advertising campaigns for other brands without your written consent
   • Claim ownership or co-authorship of your work
   • Remove your name or attribution from your work
   • Alter or modify your work without your permission

4. 3.4 Removing your content

   You may delete your content or close your account at any time. Upon deletion, your content will be removed from public view within a reasonable timeframe. Residual copies may remain in backups for a limited period but will not be publicly accessible.

5. 3.5 Your responsibility for your content

   You confirm that you own or have the necessary rights to all content you upload, that your content does not infringe the intellectual property rights of any third party, and that it complies with all applicable laws. You are solely responsible for your content and any consequences arising from sharing it on the platform.

4. Intellectual property

All content, design, code, branding, and materials produced by Artistivo — including but not limited to the Artistivo name, logo, platform design, and original editorial content such as Studio Visits — are the intellectual property of Artistivo and may not be reproduced, distributed, or used without our prior written permission.

5. Prohibited conduct

You agree not to:

• Upload content that infringes the intellectual property rights of others
• Impersonate another artist, person, or organisation
• Upload content that is defamatory, obscene, hateful, or otherwise unlawful
• Use the platform to spam, solicit, or harass other users
• Attempt to gain unauthorised access to any part of the platform or another user’s account
• Use automated tools to scrape, copy, or extract data from the platform without our written permission
• Use the platform for any unlawful purpose or in violation of any applicable regulations

We reserve the right to remove content and suspend or terminate accounts that violate these terms, at our sole discretion and without prior notice.

6. Tutors and venues

Artistivo provides a directory listing service for tutors and creative spaces. We do not verify the qualifications, credentials, or suitability of any tutor or venue listed on the platform. Users engage with tutors and venues entirely at their own risk. Artistivo accepts no liability for any agreement, transaction, or dispute arising between users and listed tutors or venues.

7. Events

Artistivo lists events submitted by users and third parties. We do not organise, manage, or take responsibility for any listed event. We make reasonable efforts to ensure accuracy but cannot guarantee that event information is current or correct. Users attend events at their own risk.

8. Privacy

Your privacy matters to us. Our Privacy Policy, which forms part of these terms, explains how we collect, use, and protect your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and, where applicable, the EU General Data Protection Regulation (EU GDPR). Please read it carefully.

9. Limitation of liability

To the fullest extent permitted by law, Artistivo shall not be liable for:

• Any loss or damage to your content arising from technical failures, unauthorised access, or circumstances beyond our reasonable control
• Any indirect, incidental, or consequential loss arising from your use of the platform
• The conduct, content, or actions of any other user of the platform
• Any loss of income, reputation, or opportunity arising from your use of or inability to use the platform

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

10. Platform availability

We aim to keep Artistivo available at all times but cannot guarantee uninterrupted access. We reserve the right to suspend, modify, or discontinue any part of the platform at any time, with or without notice, for maintenance, improvement, or any other reason.

11. Changes to these terms

We may update these terms from time to time. Where changes are material, we will notify registered users by email or by a prominent notice on the platform. Continued use of Artistivo after changes take effect constitutes acceptance of the updated terms.

12. Termination

We reserve the right to suspend or terminate your account at any time if you breach these terms or if we reasonably believe your use of the platform is harmful to other users, third parties, or Artistivo. You may close your account at any time by contacting us at hello@artistivo.com.

13. Governing law and disputes

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory rights you may have under the laws of your country of residence.
